广悦应邀欧盟商会研讨会并就直播带货中的商标侵权发表演讲

2022年3月11日，广悦律师事务所涉外法律部主办律师胡亮兼应欧盟商会知识产权工作小组邀请，在欧盟商会举办的2022年启动会议上就“直播平台销售中的商标侵权行为“的归责制度进行分享。

On 11 March 2022, at the invitation by the Intellectual Property Working Group of the European Union Chamber of Commerce in China, our Associate Lawyer Ms. Hu Liangjian of the Foreign-related Legal Service Team shared her view on the Liabilities of Trademark Infringement in Online Streaming Sales.

疫情以来，带货直播已经成为拉动电商销售的新动力，但在直播流量大潮中出现了许多涉嫌商标侵权、销售假冒产品的违法犯罪行为。而直播平台、带货主播、商品售卖方、商标持有人、商标被许可人之间复杂的关系，使直播中的商标侵权认定面临新的挑战。胡律师从行政责任、民事责任以及刑事责任三个层面进行分析，通过分析真实案例，提出在带货直播中各个相关方应如何避免商标侵权的建议。

Since the epidemic, live streaming sales of goods has become a new driving force for e-commerce, but there have been many illegal and criminal acts due to trademark infringement and counterfeit products selling in the tide of live streaming traffic. The complex relationship between live broadcast platforms, live broadcasters, commodity sellers, trademark holders, and trademark licensees has brought new challenges to the determination of trademark infringement in this complex environment. Lawyer Hu made an analysis from the three aspects of administrative, civil and criminal responsibility. By explaining real cases of trademark infringement, she offered some insights on how parties at stake can do to avoid trademark infringement in the online-streaming sales broadcast.
