The Sinopec Gas Branch South China GasSales Center was established in October 2017 to undertake pipeline gas and LNGsales, market development, terminal project development and management, feederpipeline construction and operation in Guangdong, Fujian, and Hainan regions.
On November 11, 2021, Ms. Ma Xiaoyan,Senior Partner of Wang Jing & GH Law Firm, Ms. Deng Yiyi, Ms. Fan Zuoyan,and Ms. Ji Siyu were invited to conduct a training on LNG contract riskprevention and control practice for South China Sales Center staff.
The first part of the training explainedhow to deal with the drastic price change in the LNG market, the proposedcarbon-neutral target, and the outbreak of the novel Coronavirus epidemic.After analyzing the huge fluctuation of LNG price this year, Ma Xiaoyan gave anin-depth analysis of the contractual risks prevention and control practice causedby the change of LNG price.
The second part of the training explainedhow to agree on the breach of contract clause. Ma Xiaoyan presented numerousdata and shared typical cases to determine two situations of contract liabilitybreach, namely, penalty fee and indemnity. She proposed the main points andsuggestions on the design of the relevant breach of contract clause, whichdeepened the audience's understanding of the breach of contract clause.
In addition, Ma Xiaoyan also made anin-depth and vivid analysis of contract risks prevention and control in variousaspects such as the validity of contracts, legal form of contracts, contractualnegligence liability, etc., and summarized accurately the main points of thiscontract risk prevention and control training from four aspects of prevention,pre-judgment, reservation and preparation.
Through this training, not only the riskawareness of all employees was enhanced, but also the audience learned how toidentify risk points and carry out risk prevention and control through specificcases.
