WJNGH Associate Ms. Eloisa Hu Delivers a Speech on Liabilities of Trademark Infringement in Online Streaming Sales

On 11 March 2022, at the invitation of the Intellectual Property Working Group of the European Union Chamber of Commerce in China, our associate Ms. Eloisa Hu, of the Foreign-related Legal Service Group, shared her view on Liabilities of Trademark Infringement in Online Streaming Sales.

Since the epidemic, live streaming sales of goods have become a new driving force for e-commerce, but there have been many illegal and criminal acts due to trademark infringement and counterfeit products selling in the tide of live streaming traffic. The complex relationship among live streaming platforms, live broadcasters, commodity sellers, trademark holders, and trademark licensees has brought new challenges to the determination of trademark infringement in this complex environment. Ms. Hu made an analysis from the three aspects of administrative, civil, and criminal responsibility. By explaining real cases of trademark infringement, she offered some insights on what parties at stake can do to avoid trademark infringement in the online-streaming sales.

The European Union Chamber of Commerce in China currently has more than 1,700 member companies and seven offices in nine cities. The Intellectual Property Working Group is one of the 27 working groups of the European Union Chamber of Commerce, which is composed of European companies, law firms and consultants, focusing on intellectual property protection in China. Since joining the IP Working Group of the European Union Chamber of Commerce in China in 2019, Ms. Hu has represented Wang Jing & GH Law Firm to give presentations in several webinars and events.
